Getty Images Charges Jazz Roots Rhythms
with Image Copyright Infringement
In August, 2006, Getty Images charged Jazz Roots Rhythms (JRR) with willfully. knowingly and with intent to sell and finacially gain from two Getty Images' photograph(s) that appeared on Jazz Roots Rhythms. Although it was explained that JRR is a free entertainment site, and that it has been since 1995, Getty maintained that it is a commercial site that sought to gain financially from using the photograph(s).

JRR also told Getty Images that it accepts content from content contributors that is often accompanied by images for publication. JRR further explained to Getty images that all content is submitted free of charge-- that contributors are not paid for articles, reviews, and interviews submitted to JRR.
Getty Images maintains that Jazz Roots Rhythms is liable because it should have known the image(s) submitted by a third party was illegal, even if they third party obtained it from another site, even a free graphics images site.
Unfortunately JRR has not been able to ascertain who submitted the imagery, or if said person purchased a license for it.
